1. Acceptance of Terms

By accessing or using BrandyAI ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

BrandyAI provides AI-powered content generation tools including video generation, image generation, audio synthesis, and related services. The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue it at any time.

3. User Responsibilities

You are solely responsible for all content you generate using BrandyAI. You agree not to use the Service to:

  • Generate content that infringes on third-party intellectual property rights, trademarks, or copyrights
  • Create deepfakes or non-consensual intimate imagery
  • Generate content that is illegal, defamatory, harassing, or harmful
  • Produce content depicting minors in sexual situations
  • Create content that promotes violence, terrorism, or hate speech
  • Attempt to reverse engineer or circumvent any security measures

4. Intellectual Property

You retain ownership of the content you generate using BrandyAI. However, by using the Service you grant BrandyAI a non-exclusive license to display anonymized generations for platform improvement purposes. You are responsible for ensuring your prompts and generated content do not infringe on third-party intellectual property.

5. Credits and Payments

Credits are non-refundable except in cases of technical failure on our part. Subscriptions auto-renew monthly until cancelled. Credits from subscriptions expire at the end of each billing cycle. Purchased credit packs do not expire.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CONTENT WILL MEET YOUR REQUIREMENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRANDYAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

8. Termination

We reserve the right to terminate or suspend your account at any time for violations of these terms, without prior notice.
